Definitions of the terms
The renter is the signer of the agreement to rent the pontoon, also referred to as “you” or “your”, authorized driver and are considered the same as the renter, or organization that was directed by Up North Pontoon Rentals to bill. Up North Pontoon Rentals, is considered the same as “us”, “we” and “our.” “Agreement” means all terms contained herein. “Pontoon” is any vessel that is leased as part of this contract. “Equipment” is any provided items to the renter for the duration of the pontoon rental. “Rental period” is the entire duration of time the renter is established to possess the pontoon.
Agreement
This is the entire agreement between the renter and us.
Renter Requirement
The renter must be 18 years of age and possess a valid driver's license. Renter must be on site for safety and operation demonstration. We reserve the right to rent to any individuals who feel unfit to safely operate the vehicle be it due to maturity, attention, and ease in operating the pontoon. We reserve the right to refuse service to anyone under the influence of alcohol or drugs. Anyone planning to operate the equipment must be available for safety and operation instruction and fill out any applicable forms.
Rental Indemnity, Dangers of Boating, and Warranties
Boating is inherently dangerous, and we provide no guarantee of safety while operating the pontoons. We make no warranties on the vessel in any written, spoken, express or assumed manner in reference to the pontoon or its ability to be fit for the purposes of its use. By initialing you agree to indemnify us, hold us harmless of claims, defend us, liability, and attorney’s fees we may incur resulting from your use of our rental equipment and pontoon. If any portion of this agreement is deemed void or unenforceable the rest of the remaining agreement is still binding, valid and enforceable.
Operation of Pontoon
The pontoon will be operated in a safe and careful manner. The renter release Up North Pontoon Rentals, Inc. from any financial or legal liability from the operation or any activities that occur during the rental period. The renter is solely responsible for his or her actions in the operation of the pontoon in accordance with any and all laws.
Rental location
Arrive at our business address 7129 Rapid City Road, Rapid City, MI 49676. The delivery of the pontoon location is (DNR Torch River Boat Launch) 8501 Aarwood Trail NW, Rapid City, MI 49676.
Credit Card Charges
The reservation process will require a credit card for the purchase and a $400 damage hold. The hold will be released automatically within 48 hours of the scheduled expected condition return of the vehicle. We accept all major credit cards.
Cancellation Policy
100% refundable cancellations up to 7 days before your reservation date. If you cancel within less than 7 days, you will forfeit your reservation deposit. If you cancel within 3 days of your reservation the full amount will be due. If we end up having a reservation replace your canceled pontoon in our system you will not be charged, we never like having to charge for cancellations. We reserve the right to cancel for policy violations. We do not provide discounts or refunds for early returns.
Pontoon Return
You must bring the vehicle back at the time, date, and location specified. If the vehicle is late, you will be billed at the rate of (the daily rate paid)/8 hours*2 for each hour it is late until it is recovered.
Pontoon Damage
All damages regardless of source are the responsibility of the renter while the vessel is in the renter’s rental duration. You must report accidents to us and the police department. Repairs will be assessed, and the renter will be responsible for the loss of rent and the cost of the repair $75 per hour plus parts or loss of the pontoon if it is not repairable. If the pontoon is stolen you are responsible.
Operation
I agree that I, the renter am responsible for all tickets associated with the operation of the vessel. I agree to respect all the laws and regulations of the waterways. Dusk to Dawn operation (Dark) is not allowed and is a violation of this agreement.
Other expenses incurred from renter Pontoon use
Court costs, vehicle recovery fees, attorney fees, towing, storage fees, loss of rent, impound charges, repossession fees, and any unseen costs associated with the government or other entities' detainment of the pontoon during the renter’s use will be the responsibility of the renter.
Substitutions
In the unlikely event, a pontoon is not available as selected a substitution will be provided and a credit issued if the replacement pontoon rents at a lower rate. No additional fees will be added for a pontoon upgrade if it occurs due to substitution.
Weather
If we decide to cancel the reservation due to unsafe weather you will be notified. Do not assume your rental is canceled. Call 231-331-5070 with questions. Multi-day rentals will not get refunds or credits due to bad weather, the weekly rate is set at a discount to accommodate these fluctuations. There are parts of the lake that are better for windy days, we are happy to advise on locations that are better for windy days.
Tie offs to other Boats
Not allowed.
Trailers
All of our trailers are double axle or more and a spare tire is included with each trailer. The rental of the pontoon with trailer is acceptance of the ability of the renter to change the spare tire on their own accord or direction. We will not be responsible for fees associated with loss of time or expenses incurred from a flat tire. Please notify us of the incident so that we can have a new spare tire provided to you.
Cleaning
If the boat is not returned in the clean condition when rented a cleaning fee of $200 will be assessed. Renters should be mindful to not bring color-dyed foods such as Cheetos that can damage the pontoon seat finishes. New bathing suits need to be washed before use since they will die vinyl boat seats. Other items that could cause cleaning fees are candy, excessive drink spills, human fluids, chips, suntan lotion, etc.
Fuel
We will refill the boat for you and bill you at $5-6 dollars per gallon based on the market fluctuation, we use recreational (premium) fuel. If gas is under 5 dollars for premium renter charge will be 5 dollars a gallon. We have found that customers fueling the boats themselves is stressful and difficult to plan time around, lines and accidents are common at the gas dock.
Total Agreement
I agree to all the above statements, conditions, and agreements. I have had the opportunity to ask any and all questions about the pontoon rental.
